Pursuant to the terms of the fee-based license agreement, Qualcomm granted Tianyu and Haier two companies to manufacture and sell paid patent licenses for 3G WCDMA, CDMA2000 and 4G LTE subscriber units used in China.
The previous day, Qualcomm and Qihoo 360 and Cool's joint venture Qikuo Internet Technology (Shenzhen) Co., Ltd. ("Qiku") reached the same agreement.
Earlier this month, Qualcomm and China's smartphone maker Xiaomi also reached a patent licensing agreement. Qualcomm also reached similar agreements with Chinese companies such as Huawei, TCL and ZTE ZTE.
According to sources, Qualcomm is still negotiating with Lenovo on patent licensing issues.
Qualcomm is the company with the highest number of patents for advanced 3G mobile network technologies, including CDMA2000, 1Xev-DO and its derivatives; WCDMA [2], HSPA (high-speed version of WCDMA) and its derivatives; TD-SCDMA and parts 4G patent. These inventions and patents generated by their derivatives have become a major business of Qualcomm, bringing considerable revenue to Qualcomm.
However, Qualcomm’s use of patent licensing to gain profits has been subject to antitrust investigations by the United States, South Korea, and the European Union.
Qualcomm said it worked hard to match these investigations and believed that its practices were legal.
In November 2013, the National Development and Reform Commission of China initiated an antitrust investigation against Qualcomm. On February 10, 2015, the National Development and Reform Commission announced the results of the anti-monopoly investigation and punishment of Qualcomm, ordered Qualcomm to stop the relevant illegal activities, and imposed a fine of 8% on sales in the Chinese market in 2013, accounting for RMB 6.008 billion, setting a “China†The highest fine for a single fine since the implementation of the Anti-Monopoly Law of the People's Republic of China. Regarding the above results, Qualcomm accepted that it neither applied for administrative reconsideration nor filed an administrative lawsuit.
The result of this treatment was thought to have prompted Qualcomm to reach a patent licensing agreement with a number of Chinese mobile phone manufacturers. However, Qualcomm's fourth-quarter profit in the fiscal year 2015 (ending September 27) fell 44%, and earnings expectations for this fiscal year were disappointing. As a result, Qualcomm delayed the agreement.
